TERMS AND CONDITIONS FOR ERICK GERBER SONG OVERHAUL SERVICES

Please read these Terms & Conditions (“Terms”) carefully before purchasing or using the Song Overhaul services provided by Erick Gerber (“we”, “us”, or “our”) via https://www.erickgerber.com/ (the “Website”). By submitting your musical track, project files, or materials, and completing your payment, you (“Client”, “you”, or “your”) agree to be fully bound by these Terms.
1. Description of Services & Tiers
We provide professional song feedback, structural analysis, and hands-on musical rewrites to improve both your song and your personal songwriting skills. We physically open your project files to pinpoint and execute fixes. The services are offered across three distinct tiers:
The Riff Rescue: Focused on an 8–16 bar riff that feels boring or repetitive. Delivery includes an optimized Guitar Pro file (or PDF/MIDI alternative) and a 5-minute Loom video explaining the changes.
The Riff Extrapolator: Focused on mapping out a complete structural blueprint with dynamic flow and smooth transitions from an initial riff. Delivery includes a basic guitar and drum guide via a Guitar Pro file (or PDF/MIDI alternative) and a 10-minute Loom video.
Full Song Overhaul: A top-to-bottom arrangement restructure and rewrite executed within our DAW using your audio stems. Delivery includes an updated, polished demo, basic stems, and a masterclass-style 15-minute Loom video breakdown.
Scope Limitation: While the Full Song Overhaul tier includes updated audio stems inside a DAW, our core focus is strictly on composition, arrangement, and the energy of the songwriting. This service does not constitute a final commercial mix or master.
2. Pricing, Currency, and Payments
USD Currency: All prices listed for Song Overhaul services (specifically $25 for The Riff Rescue, $75 for The Riff Extrapolator, and $145 for the Full Song Overhaul) are denominated in United States Dollars (USD).
Automatic Checkout Conversion: Prices are converted automatically at checkout. Because our operations are based in New Zealand, your financial institution or local payment processor may charge separate international transaction or conversion fees. You are solely responsible for these external costs.
Upfront Payment: Payments must be completely processed and cleared before we review your files or begin any creative modification work.
3. Technical Preparation & Deliverables
File Formats: For Tiers 1 and 2, we primarily work in the latest version of Guitar Pro, but we can back-save to older versions or deliver fixes via PDFs and MIDI-generated audio files if you do not use the software.
Audio Stem Requirements (Tier 3): To facilitate a Full Song Overhaul, you must export your tracks as continuous, consolidated WAV files starting from 0:00 so they line up perfectly in our DAW. You must also provide a tempo map (BPM) and, if possible, send both “dry” DI guitar tracks and “wet” amp-sim tones.
Turnaround Windows: You will receive your completed payload files and personalized video walkthroughs within 48 to 72 hours of submission for The Riff Rescue and The Riff Extrapolator. Full Song Overhauls will be delivered within one week of a complete file submission.
4. Subjective Nature of Songwriting (“No Hard Feelings”)
Creative Subjectivity: Songwriting and structural editing are inherently subjective art forms. While we do our absolute best to tailor creative decisions to your stated goals and song references, we do not guarantee that our creative aesthetic will perfectly align with your personal preferences.
Concept Retention: If a specific rewrite does not sit right with your personal taste, there are no hard feelings. The Loom video breakdown is designed to teach you the broader technical theory and strategy behind our choices so you can still apply those structural concepts to your original files as you see fit.
No Subjective Refunds: Disagreement with the creative direction, riffs, or arrangement changes provided does not constitute grounds for a refund.
5. Intellectual Property & Rights Ownership
100% Client Ownership: You retain 100% ownership, copyright, and control over all the parts, melodies, or riffs we rewrite.
Ghost Producer Model: Erick Gerber acts strictly as a specialized consulting editor and ghost producer. Any new transitions, parts, or lead lines created for your track belong entirely to you, and we claim zero ownership and zero royalties.
Client Warranties: By submitting materials, you warrant that you are the rightful copyright holder or have obtained explicit permission from all co-writers or collaborators to submit the project files for modifications.
Deliverable Restrictions: The personalized Loom video breakdowns are provided strictly for your personal, internal, and educational development. You may not publicly broadcast, stream, monetize, or commercially distribute the audio or video of Erick Gerber’s instructional commentary without explicit written consent.
6. Confidentiality & Privacy
We respect the privacy of your unreleased creative works. All submitted stems, Guitar Pro files, reference links, and project goals will be kept strictly secure and confidential. They will never be shared publicly or distributed to third parties without your explicit, written authorization.
7. Refund Policy
Due to the digital delivery of project assets, immediate time allocation, and custom nature of physical track edits, all sales are final. No refunds will be issued once work has commenced or files have been delivered.
For clients residing in New Zealand: Nothing in these Terms is intended to exclude or limit your statutory rights under the Consumer Guarantees Act 1993 (CGA). However, if you are utilizing these services for commercial business purposes or a professional music entity, you agree that the provisions of the CGA are excluded to the maximum extent permitted by law.
8. Governing Law and Jurisdiction
These Terms, and any legal disputes or claims arising out of or in connection with our services, shall be governed by and construed strictly in accordance with the laws of New Zealand. You unconditionally agree to submit to the exclusive jurisdiction of the courts of New Zealand to resolve any legal matters.
