Recording Guitarist – Terms & Conditions

These Terms & Conditions apply to all recording guitarist / session guitarist services provided by Erick Gerber, based in New Zealand.

By engaging these services, the client agrees to the following terms.


1. Scope of Services

The service includes the recording of guitar performances for use in the client’s musical projects. This may include rhythm guitars, lead guitars, ambient or textural parts, and related guitar-based recordings as agreed in writing.

Deliverables may include processed (wet), unprocessed (dry), and DI stems unless otherwise agreed.

The exact scope, timelines, and deliverables will be confirmed prior to commencement.


2. Work for Hire & Intellectual Property

All guitar recordings provided under this service are treated as work made for hire.

Upon full payment:

  • The client receives full ownership of the recorded performances.

  • The client may use the recordings freely in their musical works, including commercial releases.

  • The recording guitarist retains no royalty, publishing, or performance rights in the final work.

No royalties, backend payments, or future compensation are owed unless explicitly agreed in writing prior to the project starting.


3. Credit

Unless otherwise agreed, on-screen or written credit is appreciated but not required.

If credit is given, it may be listed as:

4. Payment Terms

  • All prices are quoted in New Zealand Dollars (NZD) unless otherwise stated.

  • Full payment or a deposit may be required before work begins.

  • Final files will be delivered once payment is received in full.

  • Late payments may delay delivery.


5. Revisions

The service includes reasonable performance-based revisions, such as:

  • Minor timing or feel adjustments

  • Tone tweaks within the same performance

  • Small part refinements

Revisions do not include:

  • Rewriting guitar parts

  • Changing the musical direction after approval

  • Re-recording due to changes in the client’s song structure or arrangement

Additional revisions outside the agreed scope may incur extra charges.


6. Client Responsibilities

The client is responsible for providing:

  • Accurate project information

  • Correct tempos, tunings, and references

  • Clear direction on stylistic expectations

The recording guitarist is not responsible for issues caused by incomplete, inaccurate, or late information.


7. Turnaround Time

Turnaround times are estimates and may vary depending on workload, project complexity, and communication delays.

Urgent or priority delivery may be available by arrangement and may incur an additional fee.


8. Refunds & Cancellations

Due to the custom nature of recording services:

  • Refunds are not provided once recording has begun.

  • If a project is cancelled before work starts, any payment made may be refunded at the provider’s discretion.

  • If cancelled mid-project, payment covers time already spent.


9. Portfolio Use

The recording guitarist reserves the right to use excerpts of recorded work for portfolio, showreel, or promotional purposes, unless the client requests otherwise in writing prior to delivery.


10. Limitation of Liability

The service is provided on a best-effort basis.

The recording guitarist is not liable for:

  • Commercial performance of the final song

  • Distribution outcomes

  • Third-party platform issues

  • Mixing or mastering results performed by others

Total liability is limited to the amount paid for the service.


11. Governing Law

These Terms & Conditions are governed by the laws of New Zealand, and any disputes shall be subject to New Zealand jurisdiction.


12. Acceptance

Engaging the recording guitarist’s services constitutes acceptance of these Terms & Conditions.
