Mentoring Service – Terms & Conditions

These terms apply to all one-on-one mentoring services provided by Erick Gerber (“the Mentor”, “I”, “me”) operating from New Zealand.
By booking or participating in a mentoring session, you (“the Client”) agree to the following terms.
1. Nature of the Service
One-on-one mentoring sessions are provided as creative guidance and educational support only.
They do not constitute professional, legal, financial, medical, or psychological advice.
Results may vary depending on the client’s experience level, effort, and circumstances. No specific outcomes are guaranteed.
2. Eligibility
Mentoring services are intended for musicians and creators who already have some experience writing, recording, or producing music.
I reserve the right to decline or discontinue mentoring if I believe the service is not a good fit for the client’s needs.
3. Booking & Payment
All sessions must be paid in full before the session takes place.
Session times are confirmed only once payment has been received.
Prices are listed in New Zealand Dollars (NZD) unless otherwise stated.
4. Cancellations & Rescheduling
Sessions may be rescheduled with at least 24 hours’ notice.
Cancellations or no-shows within 24 hours of the session start time are non-refundable.
In the event that I need to reschedule, an alternative time will be offered or a full refund provided.
5. Session Packs
Multi-session packs must be used within 6 months of purchase unless otherwise agreed.
Session packs are non-transferable and non-refundable once the first session has been completed.
6. Client Materials & Preparation
Any music, demos, or materials shared by the client remain the intellectual property of the client.
By submitting materials for review, the client confirms they have the right to share them.
I am not responsible for lost files, corrupted links, or missing materials.
7. Recordings
Sessions may be recorded only with mutual consent.
If a recording is provided to the client, it is for personal reference only and may not be redistributed, resold, or published without written permission.
8. Intellectual Property
Mentoring sessions do not grant ownership, co-writing credit, or rights to the client’s music unless explicitly agreed in writing.
Likewise, no rights are transferred to the client regarding my methods, frameworks, or teaching materials.
9. Confidentiality
All client information and materials are treated as confidential and will not be shared with third parties, except where required by law.
10. Limitation of Liability
To the fullest extent permitted under New Zealand law, I am not liable for any loss, damage, or outcome arising from the use of mentoring services.
Nothing in these terms limits rights under the Consumer Guarantees Act 1993, where applicable.
11. Governing Law
These terms are governed by the laws of New Zealand, and any disputes will be subject to New Zealand jurisdiction.
12. Changes to These Terms
I may update these terms from time to time.
The most current version will always apply to new bookings.
